The Hawaii Constitution was framed by a Constitutional Convention underAct 334, Session Laws of Hawaii 1949. It was adopted by the people atthe election held on November 7, 1950, and was deemed amended when threepropositions submitted to the people in accordance with the Act ofCongress approved March 18, 1959, 73 Stat 4, Public Law 86-3, wereadopted by the people at the election held on June 27, 1959. As soamended, it was accepted, ratified, and confirmed by Congress by the Actof March 18, 1959. It went into effect on August 21, 1959, upon theissuance of a presidential proclamation admitting the state of Hawaiiinto the Union. The Constitution has since been amended a number of times in accordancewith proposals adopted by the legislature or by constitutionalconvention and ratified by the people. The source of these amendmentsis indicated in the source notes immediately following the text of theamended or new section. Revision Note On November 7, 1978, amendments to the Constitution proposed by theConstitutional Convention of 1978 were presented to the electorate forits approval. The Lieutenant Governor's computer report showed that allof the proposed amendments passed by the necessary constitutionalmargin. However, the Supreme Court of Hawaii in Kahalekai v. Doi, 60 H.324, 590 P.2d 543 (1979), held that a number of the proposed amendmentswere not validly ratified. The revisor has deleted from theConstitution these invalid amendments and added explanatory notes to thesections concerned. This deletion has been done under the authority ofResolution No. 29 of the 1978 Constitutional Convention authorizing therevisor "to effect such necessary rearrangement, renumbering andtechnical changes of the sections within the articles of the StateConstitution, as may be affected, for proper form and arrangement andproper order in the State Constitution in the event that any or some ofthe amendments to the State Constitution proposed by the ConstitutionalConvention of Hawaii of 1978 are not ratified by the electorate." In addition to the abovementioned amendments, removed from the text ofthe Constitution, there appear to be other proposed amendments that mayhave failed of ratification. A number of unspecified amendments,involving technical, stylistic, and incidental changes, were submittedfor approval by the electorate under Question 34. As to these, theCourt stated: The question of whether any amendment submitted for approval by QuestionNo. 34 was in fact approved ... dependents on its effect uponsubstantive law. If the amendment is purely stylistic and technical innature, and does not alter the sense, meaning or effect of any provisionof the Constitution, it was approved by the electorate and has become apart of the revised Constitution. On the other hand, if the amendmentalters the sense, meaning or effect of any provision of theConstitution, it was not ratified and is not effective to change thelanguage of the Constitution. Obviously, we are not now in a positionto make these line by line determinations. The revisor does not consider that the authority granted underResolution No. 29 embraces the elimination of proposed amendments ashaving failed of ratification where the issue has not been adjudicated. Thus the text of the Constitution includes all the proposed amendmentssubmitted for ratification under Question 34. As an aid to the readers,however, an attempt has been made to identify all suchamendments--except those obviously purely technical and stylistic andclearly nonsubstantive (which have been ratified)--and explanatory noteshave been appended thereto. Go to Golf Courses HORSEBACK RIDING Of all the ways to explore Kauai, from horseback must be among the best. There are scenic trails that follow along the coast. Trips up Hanalei Valley, a place that hasn't changed much in the past one thousand years. Other trails take you to Haupu Valley, along the beach and past the coves of Mahaulepu Beach, or down into Waimea Canyon, known as the 'Grand Canyon of the Pacific.' Go to Stables FISHING Kauai is a popular spot for both freshwater and saltwater anglers. Large- and smallmouth bass are taken in Kauai's inland reservoirs. Marlin, ahi, ono, and aku are found in abundance off Kauai's south and east coasts. There also are special charters available that will carry you near the private island of Niihau for giant tuna and marlin. That's great news if you enjoy hiking, because it means there's a lot of island out there waiting to be explored on foot. Of course, before you set out you'll need to know where you're going. Write to the Hawaii Geographic Society, P.O. Box 1698, Honolulu, HI 96806, and ask for their information packet. A good book on the subject, Hawaiian Hiking Trails, by Craig Chisholm, offers trail descriptions by someone who has been there. You can also contact the Sierra Club, Kauai Group at http://www.hi.sierraclub.org/Kauai/kauai.html . Any of the above will prove helpful to your planning. Good maps are also necessary. The University of Hawaii Press Reference Map of Kauai is available from the Hawaii Geographic Society and at bookstores on Kauai. Maps may also be obtained from the State Division of Forestry, P.O. Box 1671, Lihue, Kauai, HI 96766. Three of Kauai's best trails: The Kukui Trail This 5-mile (round trip) trail drops 2,000 feet into spectacular Waimea Canyon, and offers the shortest route to the canyon floor. There's a large swimming hole at the bottom. The trail begins off the Iliau Loop Trail. The Kuilau Ridge Trail This 4.2-mile (round trip) hike offers dramatic views of small waterfalls and a wealth of flora. The trailhead is about a mile beyond the University of Hawaii Agricultural Experimental Station on Route 580. The Kalalau Trail This is the original Hawaiian trail into Kalalau Valley, and offers dramatic views of Na Pali Coast and Kee Beach. It begins at Kee Beach where Highway 56 ends. Two miles inland is Hanakapiai Falls, which cascades 300 feet to a pool below. The trail travels on to Kalalau Valley, and many hikers camp overnight at Hanakapiai and before continuing on the next day. The entire trip is best made by experienced hikers. Go to Land Activities WINDSURFING Anini Beach Park and Kalapaki Beach are both good places for windsurfing, especially Anini Beach because it said to have more consistent wind. On the south coast, Poipu Beach is also an excellent choice. For the more advanced, Haena Beach on the north shore is a great spot. The water is clear, with visibility averaging about 50 feet, and sea life is abundant. Go to Water Activities CAMPING Photo by: Kayak Kauai Kauai's county and state parks are ideal for camping. Both require permits. Permits for camping at county parks are issued for seven days, and enable you to camp in one location for seven consecutive days - and a total of up to 60 days at all county parks. Permits cost $3 per person per night, with children under 18 free. State park permits are free, and allow camping for five consecutive days. It is suggested that permits for state and county parks be requested up to one year in advance of arrival, especially for popular areas such as the Na Pali coast and Kokee. For other areas, try approximately one month in advance for the winter and six months in advance for the summer. The State Division of Forestry also offers camping permits for sites in the forest reserves. My drive today takes me from one season into another. I start the day in the endless summer that is Kailua-Kona-temperature a perfect, breezy 80 degrees F, but by afternoon I'm in the eternal 55-degree autumn of volcano country. Only in Hawaii. Break for the Coffee Belt I go from Kona to volcano country on Highway 11 or 180 via the Kona Coffee Belt, home of the famed, expensive bean. It's a world in miniature-tiny shops and houses tilting over the edge of lush green slopes with views of the misty blue Pacific 1,500 feet below. Make sure Driver Guy keeps his eye on the narrow, winding road as it passes through the scenic coffee villages of Holualoa, Honalo, Kainaliu, Kealakekua and Captain Cook. In the village of Holualoa, I always park in front of the rickety Kona Inn Hotel and run in to use its novel men's room. The restrooms are perched on a green cliff, with open-air views of the Pacific. Guaranteed your guy will get a huge kick out of this one. Treat this part of the drive as a coffee-tasting experience. Greenwell Farms, family-owned since 1873, lets you tour its orchards, which are white as snow in the spring when the first coffee blossoms pop out. Be sure to take home a pound or two of beans. They make a cup of joe that's wonderfully rich and strong-and redolent of the Big Island. Entering cattle country Volcano country a-waits, so head south on Highway 11. Road signs indicate the dates of the volcanic eruptions (1950, 1919, 1907) that sent lava bubbling down the slopes from the 13,680-foot Mauna Loa, which looms in the clouds somewhere above you. You'll pass in and out of thickets of eucalyptus. The smell of ripening mangoes makes the air seem-and almost taste-sticky sweet. (I always carry a plastic bag and a pocket knife on Hawaii drives. You never know when you might want to stop and pluck something tasty off a tree.) Just beyond Milolii, a quaint fishing village, follow a sign to South Point. Now you'll rumble through hot, arid cattle country. At South Point, you'll stand on a sheer and lonely bluff above the misty Pacific, the southernmost point in the U.S., the spot where the Polynesians, up from the South Pacific in outrigger canoes, first landed on these shores a thousand years ago. The first time I saw this killer view I vowed to myself, "You won't come back here alone." And I was right. When I next returned some years later, I brought my wife, who loved the whole area. However, she reminded me that she wasn't too keen on heights. We drove a short distance through the sagebrush and mesquite wilds to another end-of-the-world bay. Here she felt a little better. We gazed at some giant logs that lined the shore like lawn furniture, which had drifted all the way here from the Pacific Northwest. And you know, one made a perfect backrest for two. Hitting Hawaii Volcanoes National Park Now get set for the big climate change. You pass from summer to fall as you drive the last miles to Hawaii Volcanoes National Park. The park, 340 square miles, is all rain forest, dripping ferns and steaming fissures. Take the Crater Rim Drive, an 11-mile loop of the vast Kilauea caldera, at the center of which lies the always-steaming Halemaumau fire pit. The road dips through fern jungles, lava desert and plumes of sulphurous smoke. It's enough to give you the shivers. So warm your bones in the Volcano House, a venerable inn with tall windows looking onto the steaming caldera. The inn has a big lava-stone fireplace where a log fire has burned nonstop for 60-plus years-yes, they actually keep it stoked night and day. You can sit by the fireplace and take a nap (no one will disturb you). For dinner try Surt's, a cool cafe in the old Volcano Store. Then point the car downhill toward summer. I have always loved seeing how happy couples are to receive beautiful Hawaii wedding photographs and video. I know most couples who plan a Hawaii wedding would like to have an excellent chance to get a Romantic Sunset Photograph at the end of their Hawaii wedding. Sadly most locations won't have a sunset and most photographers don't know how to capture it on film correctly even if it did happen. New - There are many couples who come to Hawaii who think that the weather in Hawaii is always nice. Many advertisements offer a sunset wedding package even though the sunset is on the opposite side of the island. This is quite common on Kauai and Oahu. People just don't ask enough questions. Hawaii also gets rain all the time. I worked on Kauai for six years and have seen it rain on far too many weddings. The sunsets are almost never visible.Nearly 50% of Kauai weddings get rain. Hanalei gets so much rain you could have a very wet vacation. It can be very nice but you never know. Maui's free locations are usually very small and crowded. The last two times I was on Maui it rained in Wailea and Lahina. I have seen as many as 14 couples show up at the same beach for a wedding.Oahu is fun and has good shopping, I don't consider it a romantic place. Many couples sit in traffic on their wedding day. I know the best sunset wedding location in Hawaii - and it's free. The sunsets are the best in Hawaii all year. It's like a machine - almost every night. Up at Waikoloa, just 25 miles from Kailua Kona on The Big Island of Hawaii, the rainfall is about 6 inches a year. Very little rain and excellent hotels and activities.What a great combination . Other locations on Hawaii Island aren't nearly as nice. I know several of the very best Licensed Ministersin Hawaii and we are offering an unbeatable wedding package. One pro color film, one digital and one backup. This is a slow move to digital. Pro film is still nice with bright highlights - like sunset. Digital images are made availabe on your free web site. I have been editing digital video for years already. Another really great feature about having everything on CD is my ability to edit in some of the best images from the photo shoot when making wedding DVD's - really impressive. Recently we had some bad weather pass by Hawaii. The clouds turned really nice colors after sunset - very very low light and after sunset. With the digital camera I was ready to capture the moment. The scene lasted less than TWO MINUTES. The flexability of digital allowed me dial in the equivelent of ASA 800 film to capture another very special photograph for them - along with the pro film - it's an added benefit that doesn't take away from what I've been doing for many years. This flexability (changing film speed in 10 seconds) is really wonderful. The other benefits of having everything on CD things like cropping and simple retouching at no charge. Also I can make an unlimited number of images. This is great for Photo Journalism style combined with the traditional. Also, if we have everything on CD, magazine style wedding album pages are possible in PhotoShop CS - really cool. Digital cannot be ignored and we are already a digital studio (video).Digital Video is way more complex than Digital Stills.
